Violent sex offender Keith Constantin was released from prison in July after five years, but in the space of a few weeks he was run out of town twice by angry activists.
In one town, Constantin, convicted of sexually assaulting a seven-year-old boy and a 45-year-old blind woman, faced a concerted backlash orchestrated by 200 angry mothers; his face and crimes plastered on posters on every pole in town.
In the end, the pressure on Constantin became too much; he broke his curfew and is now back in police custody.
Constantin’s case highlights the vacuum between police and prison on one end and a high-risk offender in the community on the other. The space is being filled by growing numbers of grassroots activists seeking to protect their families and neighbourhoods.

In Stoney Creek, Sarah, a mother to four young children, set up a Facebook page. Residents printed and distributed posters; an online petition, “Stop the government from allowing him to live in our city,” quickly gathered more than 2,000 signatures.
Constantin could face two years in prison for breaching his curfew, but the community is still being vigilant.
Society becomes a sitting duck“Please don’t leave the group now as the ‘dust has settled.’ I am sure it won’t be long before we are discussing this all over again,” Sarah wrote on Facebook.
A similar case earlier this year caused New Brunswickers to leap to action.
Terrance Leger, 54, who had abused young boys in the rural community of Collina, returned to the area in Febuary. Again, locals held meetings, passed out posters, drew up petitions, and put pressure on the landlord who owned the house he was renting. Dave Mantin, director of the Sexual Abuse Network of Canada, who lives in Saint John, led the campaign.
Mr. Mantin operates a network of support and advocacy across Canada for people who have been abused. He also runs a public list of sex offenders, based on media reports, uses private Facebook groups to keep tabs on convicted or suspected pedophiles, and works “within the law” to monitor them, bringing concerns to the attention of police when necessary.
Neighbourhood pressure drove Mr. Leger out of Collina a few months after he returned. He moved just 20 kilometres up the road to Penobsquis.

She says she was “all-consumed” by the situation for a while and claims she saw Mr. Leger in her back yard one night. She decided enough was enough. She began driving by Mr. Leger’s house, beeping her horn. It ended with him threatening to call the police on her.
Rosalind Prober, president of advocacy group Beyond Borders ECPAT, doesn’t agree with these tactics, but she understands where they come from – a feeling of powerlessness.
When a high-risk sex offender is released from prison “society becomes a sitting duck,” Ms. Prober says.
“What we need is a systemic way of dealing with the issue so the community doesn’t have to take it on,” she said.
The Conservatives are proposing tough new legislation to establish a publicly accessible database of high-risk child sex offenders.
The current sex offender registry, only available to the RCMP, has 33,000 names. Two-thirds of those have been convicted of sex crimes against children.
If the law passes, a public database will be operational within a year.
Whether this puts the power back in the hands of the people, or creates even more community concern, remains to be seen.
Toronto criminal lawyer Stephen Hebscher sees the proposed law as simply politics, and predicts it will bring in even more activism.
“What purpose can there be to this legislation other than to further vilify child sex offenders, encourage vigilante justice and further drive them underground?” he asked.

Cpl. Martin Trudeau of the Penticton, B.C., police is aware of a new biker group in the area promising to “work in conjunction” with authorities: Urban Bulldogs Against Kid Abuse, part of an international group of the same name. The group says it has hundreds of members, patch-wearing bikers, across B.C. and Alberta, “willing to jump into action to protect abused kids 24/7.”
Organizations like this say they are not vigilantes, but their messaging is questionable. In a promotional video, UBAKA (members did not respond to requests for an interview; its Facebook groups are closed) uses graphic images with slogans like: “Hurt my kid and I’ll bury you where they’ll never find the body.” “Pedophile you came to the wrong neighbourhood.” “Hurt a kid…deal with us.”

Danielle Aubry at Calgary Communities Against Sexual Abuse calls these figures the tip of the iceberg, as sex crimes are extremely underreported – and even less so prosecuted. Ms. Aubry said it’s “incredibly concerning” that people who go through the judicial system continue to offend.
“That means we are dealing with a population of people that have come through a system that hasn’t held them accountable. The system is under resourced, we still have judges and justices who don’t understand what sex offenders are capable of… so you have people out on the streets who have not undergone counselling … it’s problematic, they come out the other end with very little intervention.”
Back in Penobsquis, Ms. Hutchinson doesn’t understand why the authorities can’t do more to curb Mr. Leger’s access to children.
“Maybe they [police] are watching him, but it doesn’t seem like it. We’ve seen kids in his yard, seen him hanging around an ice-cream parlour talking to children…. People feel helpless.”

“We had conditions put on him when he was released. He has a curfew and is not supposed to be around children. If people see that, they need to bring it to our attention. We will act on reports,” he said.
Sgt. Morgan said feelings about groups taking action are mixed.
“If it’s just about monitoring as a community, that’s OK, but if there’s false information, harassment … that’s not helpful. People need to understand they [sex offenders] have met their custodial obligation and are free members of society with the same rights as others … they deserve not to be harassed and targeted by people.”
How to deal with sex offenders once they are free is a conundrum for society, Ms. Prober says, but she believes information is power.
“I believe in the law, so any form of activity that not’s regulated is wrong, but for those raising children … having access to information, to me, that is just a basic right,” she said.
“Given their crimes, I believe they have lost the right to anonymity. Do you not have the right to know who you’re sending your kids to at Halloween?”

category of its own, as a sinister crime, was not restricted to those who

as a member of PIE, argued in 1983 that “sexual relationships with a
responsible paedophile gives a child a far greater sense of self-respect and
self-awareness… It’s a spurious protection against sexual assault, which, in
fact, works as a weapon against children’s sexual freedom,” this was duly
reported in the media as a point of view, rather than an incitement to
criminality.
Geoffrey Dickens believed that the law was being far
too soft on people with sexual designs on children. A few months before his
arrival in Parliament in 1979, a member of the public had found a package of
child pornography on a bus and handed it into the police, who traced it to no
less a person than the former High Commissioner to Canada, Sir Peter Hayman,
who was also reputedly an officer of MI6. He was a member of PIE, and one of a
group of seven men and two women who were writing to each other about their
shared interest in child sex. One of the nine was also separately corresponding
with a tenth paedophile with whom he shared fantasies about torturing children
to death.

in the eye with deep anger Tuesday and told the convicted sex offender she
wanted to tell him about her son.
The 17-year-old carries machetes
around the house because he thinks he needs to protect
himself.
He puts large knives in her
room, thinking she needs protection , to o. She said this has shattered any
sense of peace in her life.
Her son suffers daily
outbursts of anger and sobbing, breaking down for little or no reason. He’s
often suicidal, “and he lives in such a state of despair and relives his ordeal
and what you, what you, did to him.”
MacKean, 65, was sentenced
Tuesday to 18 months in jail for sexually assaulting the woman’s son when he
was 16. He was sentenced to a fur ther six months for communicating with Wayne
Alan Cunningham for the purposes of obtaining sexual services from the boy.
Within two days of being
released from prison, MacKean must report to an officer to begin three years of
probation.
The teen testified in March
that he was blindfolded with a sleeping mask and his hands and feet were
chained to a bed when a man sexually assaulted him at a cabin in Upper Chelsea,
Lunenburg County, where he was held against his will for eight days.
MacKean was convicted of
performing oral sex on him as he cried, unable to move. He had arranged the encounter
through Cunningham and texted him afterwards, hoping for another.
Cunningham was found dead in
northern Ontario, where David James LeBlanc was arrested. LeBlanc was sentenced
last June to 11 years for his role.
The mother told MacKean, who
sat quietly beside his lawyer, that her son’s ordeal “has scarred him, and it
continues to this day to plague and traumatize him.”
She said her s on is unable
to trust p eople and will likely struggle with what happ ened to him for the
rest of his life. “And for what? Your 15 minutes?”
She told MacKean her son’s
grandparents, sibling, extended family and friends are also his victims, as
they watch the teen suffer and struggle to help him .
“Not only did you rape a
young boy . . . but you raped his body, you raped his soul, you raped his
future, and that is something that cannot be fixed and I am left with trying to
pick up the pieces o f his shattered life,” said the woman, who can’t be named
because of a publication ban protecting her son’s identity.
Crown attorney Lloyd Tancock
said the mother’s words expressed the devastating effects of such a crime.
“It doesn’t go away; it’s
there for the rest of their life,” he said.
A victim can learn through
counselling to cope, Tancock said, but ultimately, “it just doesn’t go away,
and that’s the devastating impact .”
Defence lawyer Mike Taylor
agreed to the sentence that had been recommended by Tancock.
Tancock said it took into
account the abhorrence of the crimes and such aggravating factors as MacKean’s
age, the boy’s age, the fact he was bound and blindfolded and that the s ex act
was premeditated.
Taylor said his client will
be placed in protective custody and will have access to treatment programs. He
said MacKean has a hear t condition and is exp eriencing “significant health
problems.”

Paul Martin, Rick Hillier and a New Direction For Afghanistan
I don't as a rule read Jonathan Kay's column (or for
that matter, the National Post). He's far too right-wing, and when I say
right-wing, I mean that he would probably be more at home inking copy for Glen
Beck or Rush Limbaugh.
But it was Christmas Eve, and I suppose Mr. Kay was
feeling a little festive, so in a gesture of peace and goodwill, he launched a
full frontal attack on an op-ed piece written by former NDP campaign director
Gerald Caplan, that had appeared in the Globe several weeks before.
Why did he wait until Christmas eve? Who knows?
Coal in his stocking? A bit too much eggnog? Waiting
for Jacob Marley? It's any one's guess.
But our Jonathan was quite upset that Mr. Caplan was
lamenting "My country seems to be slipping away in front of my very
eyes..." I can relate, as can a great many Canadians. We have definitely
taken a sharp right turn.
Now the National Post column was pretty much the same
old, same old: Stephen Harper good, Jason Kenney new Messiah, where's my gun?
... ugh!
But then it took a kind of strange twist as Kay
started toasting former Liberal prime minister Paul Martin. (Did I mention it
was Christmas Eve and there may have been eggnog involved?)
Paul Martin will forever be known primarily as the guy
who fumbled Jean Chrétien's dynasty away to Stephen Harper. But if there were
more justice in the world — or at least among pundits — he would get his due
for making the single most momentous prime ministerial decision of the decade:
sending a Canadian combat mission to Kandahar in 2005.
At the time, it hardly seemed epic: Most Canadians
didn't know Kandahar from Kunduz. But the military wonks immediately could tell
this was a game-changer. Putting our troops in Kandahar, at the ideological and
political center of Taliban territory, meant the Liberals were shedding decades
of peacekeeper posturing, and were putting the country on a very real war
footing.
"We're not the public service of Canada ... Our
job is to be able to kill people," said Rick Hillier, another man who
deserves credit for changing this country. The then-Chief of the Defence Staff
described the Taliban as "detestable murderers and scumbags" — words
that made men like Caplan whimper and run around in little circles. In the old
Canada, one didn't say such things. To speak plainly about evil wasn't — what
was Caplan's word? — sufficiently "restrained."
I remember feeling a similar alarm when I heard
Hillier's words and especially his tone, but he seemed like a decent guy; so I
just put it down to some kind of bravado. And besides, when Jack Layton called
his remarks "disconcerting", he was accused of trying to "bestow
the most ennobled status on the Taliban---that of victim", which of course
is sheer nonsense.
But back to Paul Martin.
Now I never voted for the man. I didn't care for his
campaign strategy, and as prime minister, he was too indecisive. I thought he
was a great finance minister though and is making an excellent statesman.
In Jean Chretien's new book, he is suggesting that it
was just that kind of indecisiveness that first put our soldiers at greater
risk. After writing of his decision to keep us out of Iraq, and only agreeing to
go to Afghanistan, so long as they were in a safer region, he continues:
"Later, unfortunately, when my successor took too long to make up his mind
about whether Canada should extend our term with the ISAF, our soldiers were
moved out of Kabul and sent south to battle the Taliban in the killing fields
around Kandahar."
In Paul Martin's book, however, he states that he was
considering a change in our role, and did not just drop the ball. He still
wanted a Peacekeeping force, but thought that Canada should be better trained
and better equipped for combat, so he put money into the military and on the
advice of his defense minister, Bill Graham; in February of 2005, appointed
General Rick Hillier as chief of the defense staff.
As journalist and author Linda McQuaig puts in:
It was the Martin government that appointed Hillier
chief of defence staff and began pumping large amounts of new money into
military spending. Soon after his appointment, Hillier began pressuring Martin
to agree to U.S. requests to increase and intensify Canadian involvement in the
Afghan war. Martin was initially hesitant, but agreed to the deeper commitment
in Afghanistan, only after extracting from Hillier a promise that the Canadian
military would also have sufficient troops available to participate in vital UN
peacekeeping missions.
At a meeting with Hillier and the defence and foreign
affairs ministers on March 21, 2005, Martin stressed the importance of the
Canadian Forces being prepared to help the UN intervene, particularly in the
brutal fighting in Darfur, where hundreds of thousands of people had been
killed. Despite Hillier's assurances that troops would be available for
peacekeeping, the general argued the following spring—with the support of the
newly elected Harper government—that the military was so overworked by the
Afghan deployment that it lacked the soldiers to contribute to a UN mission to
Darfur.'

The
provincial government is asking Nova Scotians to take a big step in stopping
sexual violence: talk about it.
Specifically,
the co-chairwomen of a three-year sexual violence strategy are looking for the
public’s ideas on how to spend
$6
million over three years.
Until
July 18, people can write anonymously in an online survey about what services
would help victims of sexual violence — and what’s missing — in their
communities and the province overall.
They
are also asked how Nova Scotia can better prevent this kind of violence.
Part
of the idea behind the online suggestion box is also that victims often don’t
seek support or report to police, and many people don’t discuss sexual violence
at all.
“This
is one of the first times (that) this issue and this topic has really been
opened up in a very formal way to get feedback,” co-chairwoman Rene Ross said.
“What
we really need to do is break the silence and the shame around this issue … a
lot of folks are dealing with this issue in isolation.”
The
sexual violence strategy was launched in January with the appointment of Ross
and fellow co-chairwoman Jean Flynn and a commitment of $2 million for three
years in a row.
The
funding is to be spent on action rather than research, said Ross. She and Flynn
are hoping for a multitude of concrete suggestions about schools to police to
the health system, or any other relevant sectors.
The
survey is not meant to collect direct feedback for service providers, but to be
a broader gauge, said Flynn.
The
two are also hoping to hear about the experiences of people who belong to
marginalized groups.
“We
know we can’t have a one-size-fits-all approach to it,” said Ross. “We need a
variety of strategies.”
They
are also seeking ideas of immediate action that can be taken within the next
year, before wider changes can be made.
According
to the best data available, nearly 90 per cent of incidents of sexual violence
are not reported to police, said a government website about the strategy. In
2011 in Nova Scotia, 708 sexual assaults were reported to police, including 105
violations against children, it said.
The
term “sexual violence” refers not only to sexual acts without consent, but to
unwanted comments and gestures, Community Services Minister Joanne Bernard said
in a statement.
Ross
said the co-chairwomen are interested in hearing how to combat street
harassment as well as sexual assault, and they want to hear about support for
people struggling with historical sexual assault as well as recent cases.
From
early conversations, some repeated themes have come up, she said. They include
the need for better education about sexual consent, and challenges for some
groups in getting services, including immigrants, men and boys, and people with
disabilities.

BRIDGEWATER, N.S. — A man
convicted of sexually assaulting a 16-year-old boy at a remote cabin in Nova
Scotia has been sentenced to two years in prison.
Judge Richard Coughlan also
sentenced John Leonard MacKean to three years’ probation in his decision
Tuesday in the province’s Supreme Court in Bridgewater.
MacKean, who is in his 60s,
showed no emotion as he was sentenced.
A jury also found MacKean
guilty in March of communicating for the purpose of obtaining sexual services from
a person under 18, and Coughlan said the sentence includes six months in prison
for that offence.

The boy testified he had
been held against his will at the cabin for eight days in Upper Chelsea, about
130 kilometres southwest of Halifax.
He told the trial he was
blindfolded and chained to a bed when a man performed oral sex on him in the
cabin on Sept. 20, 2012. The youth said he was able to determine from a limited
view beneath the blindfold that the man was a balding, heavy-set man who wore
glasses.

Another man accused in the
case was sentenced last June to 11 years in prison.
David James LeBlanc pleaded
guilty to kidnapping, forcible confinement, sexual assault, uttering threats
and breach of conditions.
LeBlanc was arrested in
northern Ontario in September 2012 after a Canada-wide manhunt.
At the time, police were
also searching for Wayne Alan Cunningham, 31, whose body was later found near
the area where LeBlanc was arrested. Foul play was not suspected in his death.

An agreed statement of facts
in LeBlanc’s case said he offered the teen a painting job and drove him in a
van from Halifax to Lunenburg County in September 2012 on the pretext of
picking up supplies.
The youth later escaped and
a woman reported seeing a barefoot teenager at her doorstep, chained at his
wrists and ankles.
The Crown and the defence
made a joint recommendation for two years in prison and three years of
probation for MacKean.
The mother of the boy, who
cannot be identified under a publication ban, said in her victim impact
statement that the sexual assault left her son emotionally damaged.
“It has scarred him and it
continues to this day to plague and traumatize him,” she said, looking directly
at MacKean.

She said the young man, who
had turned 16 just months before the sexual assault, often cries and sobs for
no apparent reason.
He doesn’t feel safe and
insists on keeping large knives at home, she said.
The boy’s mother said her
son was frightened when MacKean entered the room where he was confined and
didn’t know whether he would be assaulted or if the men intended to kill him.
MacKean has damaged her
son’s future, she said, adding that left her and other members of her family to
deal with his trauma.

Coughlan said in arriving at
his sentence, he took into account that the youth was chained and blindfolded
and that “he looked young.”
He also noted MacKean had
communicated with one of the men who confined the youth to ask about having
another sexual encounter with the boy after the initial assault.
In his testimony, MacKean
denied he performed oral sex on the youth and said he was led to believe the
teen was a young adult in his 20s. If he felt the youth was distressed, he said
he would have made sure he was freed.
When he arrived, MacKean
said Cunningham told him the youth preferred to have a blindfold on because he
was shy.

The Canadian justice system is so broken it's criminal

After reading about that justice of the peace down there in Louisiana last week who refused to marry an interracial couple on moral grounds, I was feeling pretty smug and happy about not being American, as we Canadians so often do. That is, until I saw this story about a horrifically violent rapist who just absconded while out on parole in Calgary and I remembered just what a pathetic criminal justice system we have here in this country and how totally messed up Canada can also be.
Justice, Canadian Style
If you haven't read about this case already, be forewarned, it is quite disturbing.
A brief summary:
In 2001, Dean Robert Zimmerman was sentenced to jail for brutally raping, tormenting, and torturing his pregnant wife in an attack that lasted over 48 hours. He not only repeatedly assaulted her, but he also broke her nose and threatened to cut her unborn baby from her belly. And this attack took place while he was out on parole for the earlier violent rape of a 19-year-old woman.
Then, after serving less than four years in jail for that horrific attack, the guy was released and, on January 1, 2005, he committed yet another vicious attack, this time a nine-hour sex assault/torture session involving a toilet plunger and a 24-year-old Edmonton woman.
He pleaded guilty to sexual assault involving a weapon and forcible confinement and was sent away for—wait for it—40 whole months in federal prison.
Yes, that's right, forty months. That's three years and four months in prison for a savage sexual and physical assault and sadistic torture session. His third such conviction in a few short years to boot.
When exactly, one wonders, will the courts start considering this guy a threat to society and someone, perhaps, deserving of a real substantial prison sentence?
It's not just the courts though. The whole system is a joke. He was actually sentenced to six years—a rather insignificant sentence considering his crimes—but on September 29, 2009 he was released nearly three years early.
"But maybe he was reformed and repentant", you say.
Well, actually the National Parole Board describes him as a psychopath who is lacking remorse and empathy and whose violence towards women is escalating to a deadly level. Just last year they wrote that if released "There is a likelihood [he] would commit an offence causing serious harm or death".
And so they released him. And now he's skipped out on parole and is on the run.
Just the Facts
These are the facts: A man who refused prison therapy and remains an untreated, unremorseful, high-risk, psychotic, violent sexual offender was given early release last month (for the third time running).
Sounds like a perfect candidate for early release (and lenient sentencing) to me.
Hey, National Parole Board of Canada, how have those early releases been working out for this guy so far?
An Irrational, Nonsensical System
So, that about sums it up. Here in modern day Canada, you can violently brutalize, terrorize, beat, rape, and traumatize somebody for hours or even days at a time and then find yourself free on parole a few short years later, at which time you can do it all over again.
Perhaps next time this guy will get at least eight years? And maybe he can serve four or five of them this time?
The term "Canadian justice system" is simply an absurd farce and a cruel joke.
I'm not saying I want a brutal lock-'em-up-and-throw-away-the-key system like the one they have down there in the States. But come on, Canada. This is simply disgraceful. How about a little common sense?
When a psychopath rapes and tortures three different women in three separate attacks over a period of less than a decade maybe, just maybe, after his third conviction he should be locked up for a little longer than just three years.
Or maybe it's just me? Is no one else sickened, repulsed, enraged, and ashamed by all of this?
And it's hardly the first case. In fact, I'd say that extremely lenient sentencing for serious violent crimes is actually the norm here in Canada.
An Even More Disturbing Case
This Zimmerman case reminds me of another equally bewildering case from almost three years ago now. In that case a man and a woman in Winnipeg were sentenced for the kidnapping, imprisonment, and rape of two young girls, aged 12 and 13. The 12-year-old was held for several months as a sex slave and drugged, raped, tormented, and tortured while the 13-year-old was also raped numerous times and eventually became pregnant.
Like Zimmerman, this couple showed absolutely no remorse and asked for no forgiveness. So, what kind of sentence do you think they received? Yup, you got it, two years for the woman and nine years for the man. Only about half to be served behind bars of course.
As Bob Dylan sang in "Hurricane", his rage-fueled song about a different sort of miscarriage of justice, "Couldn't help but make me feel ashamed to live in a land where justice is a game".
But then again...
Perhaps I just need to be a bit more positive and a lot less pessimistic. Because, in the immortal words of Meat Loaf, two out of three ain't bad, right? The "Canadian justice system" is, in fact, almost perfect: It's definitely Canadian and it's most certainly a system. All it's really lacking is justice.
No, screw that naive positive-thinking stuff. The truth is the Canadian justice system is a lot like Bruce Springsteen & the E Street Band without Bruce Springsteen. The Sixties without the Beatles and Rolling Stones. Taxi Driver without Robert DeNiro. The Big Lebowski without the Dude. Rum and coke without the rum. Hawaiian pizza without the pineapple. Fawlty Towers without John Cleese. And The Colbert Report without Stephen Colbert.
Oh yeah, and Louisiana and the rest of the Deep South without bigots.

Aboriginal justice shames Canada’s court system

Crown Attorney Rupert Ross gives the keynote address of the Focus on Victims of Crime Conference at the Kwanlin Dun Potlatch House on Tuesday. Ross has become a champion of the aboriginal approach to justice.
Rupert Ross is “a white guy talking about Indians.”
“I didn’t want this role,” said the Ontario Crown attorney.
“That’s the last thing anybody needs.”
But after a Cree woman asked Ross to put his ideas into a book, he obliged.
“She said it was my colleagues that were killing her people, and it would take a white guy to put it in words they understand.”
Ross, who spoke at this week’s Focus on Victims of Crime Conference, has been a Crown prosecutor in remote First Nation communities for more than 20 years.
“When you work in tiny places, you get to see the results of the criminal justice system,” he said.
“And when you prosecute a man for family violence and send him to jail and then 10 years later you’re prosecuting his son for the same thing, you say, ‘This isn’t working’.
“You can’t see this easily in big cities, so you really can’t evaluate the work you’re doing.
“I could in these places.”
Ross arrived in one community to find the RCMP had not collected the witness files he needed.
“I was a little grumpy about it,” he said.
But as Ross reprimanded the officer, he noticed her eyes were welling with tears.
“In the last 14 days we cut down five kids,” she told him.
“Four are dead and one is on life support.”
But the problem is not just youth suicide, said Ross.
“The youth are killing each other.”
A bunch of kids in one of the communities decided they were going to beat up another youth, said Ross.
They got the kid in the back of a truck and the fight started while they were driving.
The kid was knocked out of the truck, then the youth backed over him before hiding his body in the woods.
“And these kids had no previous criminal records — nothing,” said Ross.
In another case, a young guy was beaten with tire irons and wrenches then hauled out of the community and buried under a pile of sticks.
“But he must have been still alive,” said Ross.
“So they jammed a big stick down his throat and stirred it.”
He died choking on his own blood.
And it’s not just youth who are at risk.
Ross covered a case where an intoxicated grandmother came looking for a drink at a house in the community.
Hours later, she was found dead with a high blood-alcohol level and a broomstick shoved up her anus.
It ruptured her kidney, said Ross.
The kid who did it was found two days later still wearing the T-shirt stained with her blood.
“I don’t know if it’s this bad in the Yukon,” said Ross.
Statistics Canada suggests it’s worse.
The rate of sexual assaults, violent crimes and robberies in the territory are triple what they are in BC or Alberta, according to a recent report.
As long as First Nation communities continue to suffer the effects of colonization under a Western paradigm, these problems will not go away, said Ross.
As the Crown prosecutor, Ross is supposed to speak on behalf of the community.
“But then, you realize you haven’t the faintest idea what the community wants,” he said.
When he was just starting out, someone sent Ross a paper on cultural differences. It talked about things like aboriginals showing respect by not having direct eye contact.
“And that was huge for me,” he said. “Because all the witnesses wouldn’t give direct eye contact, and we thought that meant they were insincere.
“And here was someone telling me, ‘No, in their culture that’s a sign of respect.’
“So I started to say, are we misreading all the people we’re dealing with? And what other stuff are we misinterpreting?”
Ross went from worrying about “doing a good job in court” to realizing First Nations are coming at justice from an entirely different worldview.
“Aboriginals don’t see the world the same way we do,” he said.
However, even knowing this, it took Ross quite awhile to realize their perspective.
Early in his career, as part of the Aboriginal Justice Directorate, Ross travelled the country examining First Nations healing programs.
On the first reserve he visited, in Cape Breton, a grandmother took Ross aside.
“She said, ‘You can go and study the programs, but until you get the sense we see the world differently than you, you won’t know what you’re seeing.’”
But the aboriginal perspective wasn’t easy to grasp.
One elder showed Ross a plant in a meadow.
Western science will tear the plant apart and name every piece, then understand what the plant is about.
“But the elder will look at the meadow and what insects, birds and animals come to that plant — she will look around the plant, not at it, and have a very different sense of the plant.”
So now you see why we have a very different idea of what justice should be, said the elder.
Ross just shook his head.
But the lessons kept coming.
Ross was told law doesn’t come from books — it’s out there (and the teacher pointed out the window).
He learned that aboriginals have many different names for the same object, depending on how it is used. A shell could be an ashtray, a candy dish or, during smudging ceremonies, a sacred vessel.
But it didn’t come together for Ross until he picked up a grandmother walking back from gathering blueberries on one of the reserves.
“I asked her about the blueberry crop that year,” said Ross.
“She answered, ‘I was out at the dump and saw 16 bears.’”
Ross asked one thing and she answered with another.
“But it was the perfect answer,” he said.
If it had been a good crop, the bears would have been pigging out on berries, not digging through garbage at the dump.
“I understood because it was the relationship between these things.”
That’s when it started coming together.
The plant puzzle suddenly made sense.
“We see the individual plant,” said Ross.
“But for First Nations, until you know the plant’s relationship to all things, you can’t say you know it.”
Same with the shell — its name changes according to its relationship with other things.
And it’s the same with justice; it’s not just a law in a book, it’s the symbiotic relationship of everything to everything else, said Ross.
It changed how Ross saw his court cases.
There was a young guy, with no criminal record, who was walking to a party and saw a bottle of rum on a table just inside an open patio door.
He couldn’t resist it.
“The youth was caught and our notion of justice would be to have him pay for the rum, etc.,” said Ross.
But it runs deeper than that.
The relationship those people had with their home was fundamentally changed by his presence.
“Their place of security was altered — that’s where the crime took place.”
After guiding the homeowners through what he calls “their downstream emotional baggage,” Ross explained it to the kid who stole the rum.
And he’d “never thought about it that way,” said Ross.
In victims’ groups, Ross once heard about a rape case where, 14 years later, the woman still would not let her grandchildren sit on her knee because she feels so dirty about what happened.
That is the crime, he said.
“Our western system focuses on the acts rather than all these downstream relational consequences.”
Aboriginal justice does the opposite.
“The sophistication and validity of aboriginal ways of looking and teaching are as important now as when the Europeans first arrived,” said Ross.
The aboriginal justice system sees victims sit down with the offender to talk out the crime.
At the start, the perpetrator is usually defensive, said Ross.
Or they show insincere remorse.
Ross remembered one case where a drunken man in his 20s grabbed the breast of a 15-year-old girl as he stumbled past.
He was charged and the family agreed to attend a circle process.
The girl was too scared to come, but her parents and her younger sister went.
The mom and dad talked about how the girl’s grades were failing and how they hadn’t seen her laugh, said Ross.
But the guy remained defiant.
It wasn’t until her younger sister talked about how every day the girl used to come home and walk the dog and today when she came home, the dog was lying outside the girl’s closed door with the leash in it’s mouth.
“A tear rolled down his cheek,” said Ross.
“That was the moment of justice.
“In the Mohawk language, when justice happens, they call it ‘the moment of face cracking.’”
It rarely happens in the western system, he said.
“And a justice system that doesn’t let an offender realize what he did, is not a justice system.”

Eric Dejaeger
While Eric Dejaeger was a priest in the
community of Igloolik in Canada, between 1978 and 1982, he allegedly had sex
with a large number of Inuit children.
In 1995, the Canadian authorities knew
of Dejaeger's alleged crimes but reportedly allowed him to escape from Canada to
his native Belgium just days before he was due to stand trial.
In
1990, Dejaeger had been briefly jailed on separate charges of sexually molesting
children in Baker Lake.
