Teen’s Violent Rape Shared on Snapchat

The mother of a 16-year-old Massachusetts girl says her daughter's brutal rape was recorded and posted to the photo- and video-sharing app Snapchat.

Three teens allegedly drugged and attacked the unnamed victim behind an elementary school in Saugus, Massachusetts, on September 3. She was found after someone recognized her as the victim in a Snapchat video.

“She had fingerprints, at least two hands held down by her throat. Her breasts were bruised, her whole body was ripped, shredded, broken toes,” her mom told NBC Boston.

It's unclear exactly how the video was shared via Snapchat, which lets users share up to ten seconds of video before it disappears. Chances are the attack appeared as a Snapchat Story, allowing anyone who was friends with the person who recorded and posted it to view it.

A 17-year-old-boy and an 18-year-old girl have both been arrested in connection to the crime, but authorities are still searching for 19-year-old Rashad Deihim, a third suspect.

Police officers are now frequently the first-line responders for those suffering a mental health or addiction problem, but training in handling these cases isn’t keeping up with the need.

To counter this, the Edmonton Police Service (EPS) teamed up with the University of Alberta to investigate a new way to improve outcomes. This research was led by Dr. Peter Silverstone and PhD candidate Yasmeen Krameddine, and the results to date are very positive.

The training focuses on improving interactions between police officers and individuals exhibiting various forms of mental illness. What makes it novel is that it uses actors to portray real-life scenarios, developed in close collaboration between police and the University of Alberta.

Police officers then interact with the actors in these scenarios. The goal is to increase skills in active verbal/non-verbal communication, de-escalation techniques, empathetic understanding and mental-health knowledge.

This program is run as a one-day intensive training program with six scenarios: depression, addiction, schizophrenia, alcohol withdrawal, mania and a suicidal individual.

It allows officers to improve their interactions in real-life situations. One important part of the training is the use of professional actors, who give feedback to the officers after each scenario. This is in addition to feedback from more senior training officers.

The actors are trained to acknowledge both the positive and negative behaviours of each officer during the scenario, giving officers in-depth feedback on how the officer made the actor feel during the interaction. Feedback is crucial for officers to understand how their actions affect the emotions and behaviour of individuals they come in contact with. The actors were trained extensively on verbal and non-verbal communication techniques, and varied their interactions depending on what the officer said or did.

For example, if the officer rolled his or her eyes, didn’t listen to what was being said or tried to rush the actor, the actor would in turn behave more belligerently and less helpfully.

In contrast, if the officer looked engaged, gave the actor his or her attention and held eye contact, the actor would be more relaxed, helpful and supply all the information asked for.

Emphasis during the feedback for each scenario was on increasing the expression of empathic feelings and body language expressed to the actors in the scenarios.

After the scenario was complete, the feedback continued to highlight why the actor behaved in certain ways. This allowed police to have an outside perspective of their actions and body language, giving them a better view of how their actions or what they said impacted the way they are viewed.

An example of feedback from an actor would be “When you asked me my name, I felt like you actually cared about me, as a person, so I was comfortable in answering your questions” or “when you told me to calm down it made me angry because your tone suggested you didn’t care why I was so angry.”

To date, more than 650 police officers have completed this training. Results have been very positive.

Over a six-month period, EPS members demonstrated significant improvements in their communication, empathy and de-escalation skills, as observed by their supervising officers.

Additionally, there was an improvement in an officer’s ability to confidently recognize, respond and empathetically communicate with individuals in distress.

This supported a 41 per cent increase in the actual number and classification of mental health calls, with 19 per cent less time being spent on each call, thus an increase in efficiency. Over a six-month period, this led to cost savings of $83,828.

Additionally, police reported feeling significantly more confident in their training and ability to interact with a mentally ill individual. There was also a large decrease (more than 40 per cent) in the use of any kind of force when interacting with mentally ill individuals, although there were other internal police initiatives that may have helped this latter figure.

These results show promise, and continue to emphasize the positive effects of this innovative mental health training initiative. What’s interesting about the research that was done, and the tips provided, is that little things can make a big difference.

Active listening and expressing empathy in both verbal and non-verbal communication improves outcomes for police officers, particularly when interacting with those who have mental illness and/or addiction problems.

This study also shows that these skills can be taught and improved, and that this leads to true-to-life training and real-life application. Feedback from officers taking part repeatedly said how realistic the scenarios were and that they were able to subsequently incorporate these skills into their daily tasks.

Dos and don’ts for talking to people with psychiatric problems

Try to do the following:

Ask individuals their name in a conversational manner, and offer yours. This small act of bonding can go a long way in developing an understanding and empathetic relationship.

Active listening. This is done by keeping attention and maintaining eye contact on the individual. You can also summarize what they say by repeating it back to them. Nod your head up and down to demonstrate strong non-verbal understanding. If you show you are actively listening, you will increase empathy with the subject, helping you gain any information and insights you need.

Use “open” body language. Body language is an unconscious form of communication that can escalate or de-escalate situations depending how it’s used. Keep a calm and relaxed posture, try not to cross your arms, smile and show you’re concerned. These behaviours allow the subject to feel safe and trusted.

Mirroring. Copy their body language if you can. It’s a powerful way of empathizing using non-verbal communication.

Label and confirm their feelings. Since feelings and emotions are frequently a major cause of problems, labelling their feelings shows you are listening, for example, “It sounds like you’re feeling very underappreciated.” Confirming also helps them see that their feelings are normal, such as “anyone would feel sad after losing their job.”

Focus on family. By asking the person about their family or friends, you can decrease their isolation and remind them that they have people in their life. Examples may be “do you have any children?” and “what would your children do if they no longer had you in their life?”

Tell them what you are doing and why. Research shows that if you explain to the individual what you have to do and why, there will be less chance of aggression and escalation. For example “I am going to have to arrest you because it looks like there are five warrants out for your arrest.”

Try not to do the following:

Telling them to “calm down” or “relax.” These words may make them angry because they feel they’re being talked down to and told what to do. This does the opposite of making someone feel calm.

Using dominating body language. Standing over an individual with your feet planted, hands on your waist or on your gun, can indicate control and power. This may make the person feel defensive, powerless and unimportant. They are less likely to be co-operative. If they’re sitting, try instead to crouch down to their level, so you’re able to talk to them as equals.

Improper mirroring. Copying isn’t always appropriate. If they’re shouting, don’t shout back, no matter the provocation. Try talking in a softer voice so they have to stop to listen to what you are saying. Also, if the person is scared or anxious, mirroring their body language can exaggerate anxiety and fear, which may escalate the situation. Keep a calm demeanor, even if they are not. Eventually and without realizing it, many subjects will copy your body language.

Telling them they shouldn’t feel a certain way. All feelings are real no matter how outrageous it sounds. Do not belittle what the subject is experiencing. For example, if a subject is hearing voices, don’t say “no, you don’t hear that.” Instead, ask more about the situation: “How long have you been hearing them?” or “How do they make you feel?”

Victim’s family ‘saddened’ by sentence in Lower Sackville sex abuse case

A Lower Sackville man found guilty of molesting two young girls has avoided federal prison time, much to the chagrin of the father of one of the victims.

Gordon Arthur Gallie, 64, was sentenced Monday in Nova Scotia Supreme Court in Halifax to one year in a provincial jail.

A jury convicted Gallie last year on five charges – two counts of invitation to sexual touching and single counts of sexual assault, sexual interference and common assault. The sexual assault charge was stayed at sentencing.

The one-year jail sentence imposed by Justice Simon MacDonald was recommended by the defence. The Crown asked for a three-year sentence in a federal penitentiary.

Gallie will be on probation for two years after he gets out of jail, with a condition requiring him to complete an assessment and treatment program for sex offenders.

The father of one of the girls, however, contacted The Chronicle Herald to express his outrage at the judge’s sentencing decision.

“As a family, we are deeply saddened and troubled by the sentence (Gallie) received for the crimes,” the man said in an email. “We applaud the work done by (police) and the Crown attorneys. … The judge, however, rubbed salt into very deep wounds.”

The offences were committed between June 2009 and September 2010 at Gallie’s mobile home on Parklane Drive.

The complainants, whose identities are banned from publication, were 10 and nine when they went to police in the fall of 2010.

The older girl testified that she and Gallie performed oral sex on each other a number of times. She said he asked for oral sex from her and the other girl when they were at his trailer together but they didn’t comply. Gallie touched their bums before they left, she said.

“We felt that a term in a federal penitentiary was appropriate given the nature of the offences,” Crown attorney Alicia Kennedy said.

“These were very, very serious offences. They were committed against two girls, and the abuse that happened to one of the girls was … oral sex between a nine-year-old and a man in his 60s.”

Kennedy said it’s too early to say if the Crown will appeal the sentence.

The father said the abuse left his daughter, now 13, with emotional scars that might never heal and destroyed the other girl’s life, as she was abandoned by her family and is now bouncing around in foster care.

“I believe that the trial judge let everyone down by his actions and decisions,” the man said. “This kind of punishment for crimes against the most vulnerable in our society only increases the public perception that this sort of crime will not be punished.

“Most victims will never come forward for fear of being dragged through years of being further victimized by the system, leaving these human parasites to further victimize people.”

Defence lawyer Peter Planetta said his sentencing recommendation fit the circumstances of the conviction.

“The conviction is being reviewed and I expect a notice of appeal to be filed shortly,” Planetta said.

The judge ordered Gallie to provide a DNA sample for a national databank and to register as a sex offender for the rest of his life.

MacDonald also imposed a lifetime weapons ban and prohibited Gallie from going to parks, playgrounds, schools and other places frequented by children for a period of 10 years.

In a separate trial, Gallie was acquitted on a charge of possessing child pornography.

  However, Saint Mary’s Uni­versity criminology professor Stephen Schneider said the non-Criminal Code aspects of policing have increased exponentially over the last 30 years.

“Thirty years ago, if there was a bullying incident at school or a domestic violence issue, you didn’t call police," he said in an interview, noting that these issues now take up a significant amount of police time.

In addition, Schneider said police are confronted with an increased workload due to federal government cutbacks related to mental health and affordable housing .

“Police have now become the main institution in society to deal with the mentally ill and that, without a doubt , has added to policing costs."

Despite the increasing role of cops, he said the soaring policing costs are unsustainable.

B.C. child-sex offender released from custody

Police in B.C. laid 10 new charges on a convicted sex tourist accused of child sex offences in both Canada and Cambodia.

Christopher Paul Neil, known as "Swirly Face" for the way he digitally distorted his face in sexual abuse photos posted online, spent five years in a Thai prison after being found guilty in 2008 of molesting children in that country.

He was arrested Sept. 30, 2012 as he stepped off a plane in Vancouver, under a section of the Criminal Code pertaining to actions that can cause fear of sexual offences to persons under the age of 16.

Neil, 37, was released from custody less than a week later under strict conditions, including he not own any devices capable of accessing the Internet.

RCMP continued to investigate allegations he had raped young boys in Vietnam and Cambodia, while Vancouver police allege he has possessed and viewed child pornography since his return.

On Friday, he was charged with offences including sexual touching in Cambodia and possession of child pornography in Canada.

Neil remains in custody pending his next court appearance Monday.

CLARIFYING CONSENT LAW 

A March 26 article on the new Cana­dian film, The Husband, gives mis­leading information about the age of consent for sexual activity in Canada.

The film involves a teacher having sex with a 14-year-old student. In the Canadian Press article, the director is quoted as saying, “Well, the kid’s 14, he’s old enough ..." In 2008, Canadian law governing the age of sexual con­sent changed. If a youth is 14 or 15, there must be less than five years between the youth and the older sexu­al partner. Although people age 16 or more (but under 18) can legally con­sent to sexual activity, consent is not legal if one of them is in a position of trust or authority over the other (i.e. a teacher), or is a person upon whom the other is dependent.

There are various additions and exceptions that I have not included here. For more information, search the federal Justice Department website or call a sexual health centre. Member centres of the Nova Scotia Association for Sexual Health (NSASH) are listed at www.nssexualhealth.ca .

Further protection for children from sexual offenders

In Canada, over 3,900 sexual violations against children were reported to police in 2012, an increase of 3 percent from 2011. The same increase was seen from 2010 to 2011.
Our Government is committed to strengthening measures that will protect communities from child sexual offenders, including punishing offenders to the full extent of the law and ensuring that the justice system is more responsive to children who have been victimized and to their families.
To this end, our Government will bring forward new measures this fall that build on the work that has already been done to combat child sexual exploitation. The proposed new measures to amend the Canadian legislation would include:
" Requiring those convicted of child pornography and related offences to serve their sentences consecutively - one after another. This would apply particularly to offenders who have victimized multiple children;
" Increasing maximum and minimum penalties for child sexual offences;
" Increasing penalties for violation of conditions of supervision orders;
" Ensuring that if a crime was committed while on parole or statutory release, it would be a mandatory factor in sentencing; and,
" Ensuring that the spouse of a person charged with child pornography offences could be obliged to testify in court.
Since 2006, our Government has taken action to better protect children, including:
" Putting in place, through the Safe Streets and Communities Act, new mandatory minimum penalties for seven existing Criminal Code sexual offences, including assault, assault with a weapon, and aggravated assault (where the child is under 16 years);
" Making it illegal for anyone to provide sexually explicit material to a child for the purpose of facilitating the commission of an offence against that child - this process is often referred to as "grooming";
" Making it illegal to use computers or other means of telecommunications to agree or make arrangements with another person to commit an offence against a child;
" Strengthening the sex offender registry;
" Increasing the age of protection - the age at which a young person can legally consent to sexual activity - from 14 to 16 years of age;
" Putting in place legislation to make the reporting of child pornography by Internet Service Providers mandatory; and,
" Strengthening the sentencing and monitoring of dangerous offenders.
Broader measures that our Government has taken to help young victims of crime include:
" Providing over $10 million for new or enhanced Child Advocacy Centres (CAC) since 2010. So far, CAC projects have been funded in 20 cities or municipalities across Canada. Teams of professionals at these centres help young victims and witnesses cope with the trauma they've experienced and to navigate the criminal justice system;
" Launching GetCyberSafe.gc.ca, the Government of Canada's public awareness website on online safety. The site contains information for parents on how to protect their children from people who go online with the purpose of exploiting, manipulating or abusing children;
" Joining the Global Alliance Against Child Sexual Abuse Online in June 2013. The goal of the Global Alliance is to strengthen international efforts to fight Internet predators and child abuse images online. It focuses on identifying and helping victims, prosecuting offenders, increasing public awareness and reducing the availability of child pornography online;
" Consulting with the public and stakeholders to better understand the various views of what rights should be recognized and protected by a federal Victims Bill of Rights. These consultations are critical in identifying and recognizing how to better entrench the rights of victims into a single law at the federal level, as part of the Government's commitment to victims of crime; and,
" Allocating more than $120 million since 2006 to respond to the needs of victims of crime through programs and initiatives delivered by the Department of Justice Canada.
