Child sex abuse by women is significantly more widespread than previously realised, with experts estimating that there could be up to 64,000 female offenders in Britain.
Researchers from the Lucy Faithfull Foundation (LFF), a child protection charity that deals with British female sex offenders, said its studies confirmed that a "fair proportion" of child abusers were women. Donald Findlater, director of research and development, said results indicated that up to 20% of a conservative estimate of 320,000 suspected UK paedophiles were women.
The release of the figures comes days after a Plymouth nursery school worker, Vanessa George – together with Angela Allen from Nottingham and Colin Blanchard from Rochdale – pleaded guilty to sexually abusing young children.

A Polk County female teacher already jailed for supposedly carrying on a love affair with a 17-year-old student now faces 20 additional counts of unlawful sex with another student, the Polk County Sheriff's Office announced Wednesday.
Jennifer Fichter, 29, was jailed last week after her alleged four-month sexual relationship with a 17-year-old boy at Central Florida Aerospace Academy in Lakeland came to light. Polk County sheriff's investigators this week say the English teacher had consensual sex with another one of her students over a seven-month period beginning in October 2011.
The 17-year-old boy was a junior in Fichter's English class at the time, and the two communicated with a texting application which the boy downloaded to his iPod since he did not have a cell phone, according to an arrest report. The boy told investigators at first he and Fichter two would spend time in the teacher's apartment watching TV and cuddling on the couch in September 2011. According to David Finkelhor, director of the Crimes Against Children Research Center at the University of New Hampshire, U.S.A. and stated in one of the largest newspapers in the U.S.A., the rise in recognition and prosecution of female sexual predators is due at least in part to the increased number of female police officers. Apparently, this results in prosecution of female sexual predators for their crimes without the police being labelled misogynistic.

The Invisible Boy: Revisioning the Victimization of Male Children and Teens
Female Perpetrators
As recently as 10 years ago, it was a common assumption that females did not or could not sexually abuse children or youth. Even some professionals working in the field believed that women represented only about 1% to 3% of sexual abusers at most. However, mounting research evidence about sexual abuse perpetration at the hands of teen and adult females has begun to challenge our assumptions, though these earlier and dated views still tend to predominate.
The percentage of women and teenage girl perpetrators recorded in case report studies is small and ranges from 3% to 10% (Kendall-Tackett and Simon, 1987; McCarty, 1986; Schultz and Jones, 1983; Wasserman and Kappel, 1985). When the victim is male, female perpetrators account for 1 % to 24% of abusers. When the victim is female, female perpetrators account for 6% to 17% of abusers (American Humane Association, 1981; Finkelhor and Russell, 1984; Finkelhor et al., 1990). In the Ontario Incidence Study, 10% of sexual abuse investigations involved female perpetrators (Trocme, 1994). However, in six studies reviewed by Russell and Finkelhor, female perpetrators accounted for 25% or more of abusers. Ramsay-Klawsnik (1990) found that adult females were abusers of males 37% of the time and female adolescents 19% of the time. Both of these rates are higher than the same study reported for adult and teen male abusers.
Dynamics of Female-Perpetrated Abuse
Some research has reported that female perpetrators commit fewer and less intrusive acts of sexual abuse compared to males. While male perpetrators are more likely to engage in anal intercourse and to have the victim engage in oral-genital contact, females tend to use more foreign objects as part of the abusive act (Kaufman et al., 1995). This study also reported that differences were not found in the- frequency of vaginal intercourse, fondling by the victim or abuser, genital body contact without penetration or oral contact by the abuser.
Females may be more likely to use verbal coercion than physical force. The most commonly reported types of abuse by female perpetrators include vaginal intercourse, oral sex, fondling and group sex (Faller, 1987; Hunter et al., 1993). However, women also engage in mutual masturbation, oral, anal and genital sex acts, show children pornography and play sex games (Johnson, 1989; Knopp and Lackey, 1987). The research suggests that, overall, female and male perpetrators commit many of the same acts and follow many of the same patterns of abuse against their victims. They also do not tend to differ significantly in terms of their relationship to the victim (most are relatives) or the location of the abuse (Allen, 1990; Kaufman et al., 1995).
It is interesting to note in the study by Kaufman et al. (1995) that 8% of the female perpetrators were teachers and 23% were babysitters, compared to male perpetrators who were 0% and 8% respectively. Finkelhor et al. (1988) also report significantly higher rates of sexual abuse of children by females in day-care settings. Of course, Finkelhor's findings should not surprise us given that women represent the majority of day-care employees.
Research on teen and adult female sexual abuse perpetrators has found that many suffer from low self-esteem, antisocial behaviour, poor social and anger management skills, fear of rejection, passivity, promiscuity, mental health problems, post-traumatic stress disorder and mood disorders (Hunter et al., 1993; Mathews, Matthews and Speltz, 1989). However, as in the case of male perpetrators, research does not substantiate that highly emotionally disturbed or psychotic individuals predominate among the larger population of female sexual abusers (Faller, 1987).
There is some evidence that females are more likely to be involved with co-abusers, typically a male, though studies report a range from 25% to 77% (Faller, 1987; Kaufman et al., 1995; McCarty, 1986). However, Mayer (1992), in a review of data on 17 adolescent female sex offenders, found that only 2 were involved with male co-perpetrators. She also found that the young women in this study knew their victims and that none experienced legal consequences for their actions.
Self-report studies provide a very different view of sexual abuse perpetration and substantially increase the number of female perpetrators. In a retrospective study of male victims, 60% reported being abused by females (Johnson and Shrier, 1987). The same rate was found in a sample of college students (Fritz et al., l 981). In other studies of male university and college students, rates of female perpetration were found at levels as high as 72% to 82% (Fromuth and Burkhart, 1987, 1989; Seidner and Calhoun, 1984). Bell et al. (1981) found that 27% of males were abused by females. In some of these types of studies, females represent as much as 50% of sexual abusers (Risin and Koss, 1987). Knopp and Lackey (1987) found that 51% of victims of female sexual abusers were male. It is evident that case report and self-report studies yield very different types of data about prevalence. These extraordinary differences tell us we need to start questioning all of our assumptions about perpetrators and victims of child maltreatment.
Finally, there is an alarmingly high rate of sexual abuse by females in the backgrounds of rapists, sex offenders and sexually aggressive men - 59% (Petrovich and Templer, 1984), 66% (Groth, 1979) and 80% (Briere and Smiljanich, 1993). A strong case for the need to identify female perpetrators can be found in Table 4, which presents the findings from a study of adolescent sex offenders by O'Brien (1989). Male adolescent sex offenders abused by "females only" chose female victims almost exclusively.

The Ontario College of Teachers withdrew the teaching licence of Jennifer Dorland, 42, earlier this month after finding her guilty of eight counts of professional misconduct under the Ontario College of Teachers Act.
Ms. Dorland, who now goes by the name Jennifer Toews, pleaded no contest to the accusations. She did not attend the May 6 hearing or have a lawyer make arguments on her behalf.
In their decision, the three-member disciplinary panel found that Ms. Dorland's actions "betrayed the trust of students, parents and the public." More..

Babysitter jailed for sexually assaulting boy

QUEBEC (CP) - A Quebec woman who  had sex   with a 13-year-old boy has been sentenced to 15 months in prison.
The  relationship  between Julie Dorval, 31, and the boy began after the youth made advances over the Internet. Within about three months they had sex on several occasions. Youth protection services were called after Dorval and the teenager were seen walking hand-in-hand and hugging each other. Dorval pleaded guilty last April to sexual assault.
Prosecutors had been seeking a sentence of at least two years in a federal penitentiary, while the defence suggested a conditional sentence of nine to 12 months.

Then there is Charlotte Mae Thrailkill.
The 43-year-old mother of two is California's only female violent sex offender, confined to a maximum-security state mental hospital after experts decided she was too dangerous for release.
Only a handful of women, including Thrailkill, have ever been confined to mental institutions under state laws that allow for civil commitments of sex criminals after they have served their prison terms.

Women are less likely than men to commit sex offenses, but they also are less likely to be reported and prosecuted. Many experts contend that women commit sex offenses far more often than is generally believed.
"It happens a lot more than gets reported, and I think part of that is due to our culture," said Steven B. Blum, a consulting psychologist to a sex offender program in Nebraska. "There are a lot of women who have sexual contact with teenage boys, and they don't get reported."
Paul Federoff, a forensic psychiatrist in Ottawa, Canada, said one of the female sex offenders he counsels is an exhibitionist. She opens her living room curtains and strips off her clothes when people pass by.
He told her that unless she stopped this illegal activity, she would be arrested.
" 'Doctor, if someone calls up and says he saw me disrobing in the window, who do you think they are going to arrest? Me or him?' " Federoff said she replied.

Police arrested the woman May 12 after she exposed her breasts to a passing truck at the intersection of St. John's Avenue and Charles Street, in plain view of a nine-year-old boy a short distance away.
"I didn't mean to do that in front of the kid, I didn't see him," the woman said.
Court heard the woman "frequently acts impulsively" and lives on her own with the support of around-the-clock social workers.
At the time of her arrest, the woman was bound by a strict probation order in connection with a similar incident two months earlier.

WINDSOR, Ont. -- She gave him life and was the only parent he ever knew. In the way she snapped photos of him sleeping and playing happily, she was like any other adoring mother. But she also committed unspeakable acts to his little body, turning him into a human sex toy in her pornographic broadcasts.
The set of facts involving the Windsor-area mother who sexually abused her two-year-old son horrified both those involved in the case and those who’d only heard about it.
“Society expects the mother of a toddler would do everything in her power to make sure her child is protected from harm,” said the judge who on Friday handed the 24-year-old woman a 3 1/2-year prison sentence.
He called her crimes “appalling” and “abhorrent.”
While female sexual abusers are rare in the court system, those who deal with child sexual abuse know the woman is not unique. She may be the first Ontario woman to be jailed for making child pornography featuring her own offspring, but she’s not the first mother to sexually abuse a child.
A national study released in 2005 shows that biological mothers were the perpetrators of sexual abuse in 5% of the substantiated cases investigated by child welfare authorities.
The instance is probably higher, since researchers are certain that many cases of child sexual abuse never come to light. “A lot of people have difficulty believing women are capable of sexually abusing children,” said social worker Angela Hovey, whose doctoral thesis deals with a topic related to this theme. As Susan Koeppen observed on The Early Show Thursday, the majority of sex offenders are men, but it's the women who get a lot of the attention.
When a beautiful teacher seduces a student, some people think, "What's the harm?"
But Koeppen spoke with one student who says his  "affair"  with a teacher left him devastated.

BAYONNE, N.J. Many in this gray, insular city are at a loss to explain why Diane Cherchio West was allowed to continue working in the public school system for two decades after she was caught in 1980 kissing and groping a 13-year-old student at an eighth-grade dance.
Why, after her promotion to guidance counselor at Bayonne High School, no one alerted social services, school officials or the police when she became pregnant by an 11th grader she supervised, Steven West, and married him upon his graduation in 1985.
Or why, when that baby, Steven Jr., grew to be a teenager, no one balked as his 15-year-old friend moved in with Ms. West, who then seduced the friend with Scooby-Doo boxer shorts and evening jaunts to sports bars and used her school authority to rearrange his classes around their  secret trysts.
It was not until 2001, when relatives of the boy, Christopher Castlegrande, filed a complaint with the police of statutory rape against Ms. West, that she left her $74,000-a-year job and lost her unfettered access to Bayonne High Schools students.  More ..

COLUMBUS, Ohio -- A woman who lied about getting pregnant through date rape and abandoned her newborn in a trash bin was sentenced to prison for the statutory rape of the baby's father, her 12-year-old cousin.
Twyana Davis, 30, claimed in 1995 that she had been raped at a party, and told her story in a book and on television.
Davis was sentenced Tuesday in Franklin County Common Pleas Court to 10 to 25 years in prison. She had confessed to having a  sexual relationship  with the cousin, leading to her pregnancy.
Judge Michael J. Holbrook labelled her a sexual predator and fined her $10,000.  More ..

On Tuesday, Walls was sentenced to one year in jail and will also be on probation for five years. Walls had faced up to five years and six months in prison. She could have been sentenced to as much as 16 years in prison if she had been convicted of all the original charges.  More ..

In courtrooms nationwide this month, at least seven women four of them teachers have been charged or sentenced for  having sex  with boys, mostly teenagers. One of the women is pregnant.
Tuesday in Georgia, Lisa Lynette Clark, 37, was indicted in the molestation of her son's 15-year-old friend, who she says is the father of the baby she's expecting. She was arrested one day after marrying the boy.
No definitive data exists on whether more females are sexually abusing children. Yet the number arrested for sex crimes has risen in five of the past six years as more people consider molestation of boys as heinous as that of girls.
"There's been a decline in the double standard. That's why you're seeing more of these cases," says David Finkelhor, director of the Crimes Against Children Research Center at the University of New Hampshire. As more women enter law enforcement, he says the old attitude that boys are willing, even lucky, participants has changed.  More ..

FORT WORTH, Texas -- A 13-year-old boy took the witness stand in the Tarrant County Courthouse Tuesday to testify against a teacher at a Catholic school. The boy told jurors that he and the teacher had a  sexual relationship , and that she promised the boy she would leave her husband so she and the boy could get married when he turned 18.
The allegations of sexual contact included episodes of bondage, during which 30-year-old Dawn Reiser is accused of tying up the boy to engage in repeated sexual encounters. The prosecution produced scarves allegedly used by Reiser to bind the boy.
The jury also saw love letters allegedly sent by Reiser to the boy. A DNA expert testified about saliva that sealed the envelopes.  More ..

The  sexual conduct  occurred during a game of "truth or dare" while the boy was being watched by the babysitter.

When a female teacher in Tennessee was charged this week with  having sex  with a 13-year-old male student, the case focused attention on a type of sexual abuse that often goes unreported.
While there is a greater awareness of such crimes, the Tennessee prosecutor pursuing the recent case, along with several psychologists, say such incidents are still viewed less seriously than those involving grown men and girls.
"Unfortunately, they look at it as the 'Mrs. Robinson syndrome' and think everything is OK," says Dale Potter, district attorney for Warren and Van Buren counties in Tennessee. He was referring to the woman in the 1967 film The Graduate who seduces a younger man.
"But it's my understanding there are some long-term effects for male victims in this kind of situation," he says. "And from my perspective, a sex-abuse case is a sex-abuse case. We don't look the other way as to who the victim is and who the suspect is."

SYDNEY, Australia (Reuters) -- An Australian female teacher has been jailed for six months for  having sex  with a teenage student, with a warning from the judge that future offenders could not expect such "lenient" treatment.
Karen Louise Ellis, a 37-year-old physical education teacher, had earlier received a suspended sentence of 22 months after she pleaded guilty to six counts of sexual penetration with a boy aged under 16.
But the Supreme Court of Victoria's Court of Appeal in Melbourne upheld an appeal by prosecutors against the leniency of that sentence, saying that mother-of-three Ellis should have been sentenced to two years' jail on each of the counts.  More ..
CanadianCRC editor: Notice the words "having sex"  in the article and  in the title "affair".  This is gender discrimination. You won't find articles that call it an "affair"  when the sexual offender is a 37 year old male teacher and the victim is a teenage girl under 16 years of age.   Why did the judge consider giving, in the judge's own words,  a "lenient" sentence?  A 37 year old man would not have initially received a suspended sentence for 6 counts of sexual penetration of girl under 16 years of age.

Mother faces 22 boy-sex charges

A female integration aide at a Victorian school has been charged with sexual offences against a boy in her care aged under 16.
The woman, 36, an integration aide at a government secondary school on the Mornington Peninsula, worked with the boy, who suffers from language difficulties, three days a week.
The student is not intellectually disabled.
Most of the offences are believed to have happened at the boy's home. The woman is believed to have lived with the student and his family for some time this year while going through a traumatic separation. The alleged  sexual affair  took place over eight months.

Jodi Thorp, 35, surrendered to authorities Monday on charges of aggravated sexual assault, aggravated sexual contact and endangering the welfare of a child. Prosecutors claim she had sex with the boy at her Mendham home between June 2001 and September 2002. The boy is now 15.

Female teachers accused of sex crimes against underage male students have been grabbing headlines lately. Many of them are young and beautiful, their stories sordid and intriguing.
But to law enforcement, they're something else criminals who have committed statutory rape against a minor.
This week alone, two cases have hit the news: Cops say one Texas teacher, Kathy Denise White  had sex with a 17-year-old, and Tennessee teacher Pamela Rogers Turner had sex with a 13-year-old boy.
They join at least three other recent cases: Florida teacher Debra LaFave (search), 24, is expected to plead insanity to charges  she had sex with a 14-year-old student , according to her lawyer; California teacher Sarah Bench-Salorio, 28, allegedly molested two boys when they were 12 and 14; and 33-year-old California teacher Rebecca Boicelli was arrested last month on statutory rape and related charges after DNA tests confirmed that a former student fathered her 2-year-old baby when he was 16.   More ..

Each province and territory is struggling to maintain Canada’s dysfunctional sex offender registry
A recent Maclean’s investigation uncovered a long list of serious flaws in Canada’s three-year-old sex offender registry. Hundreds of rapists and pedophiles are missing. Hundreds more were never added to the system in the first place. In this web exclusive, macleans.ca provides a region-by-region breakdown of all the shocking problems—and all the warnings that the federal government continues to ignore. Canada’s national sex offender registry was created for one reason: to help police locate potential suspects. If a child goes missing, investigators can search the database for known pedophiles who live in the surrounding postal codes. If a stranger rapes a woman, police can input her attacker’s description and scan for matches. “What the registry does is eliminate the three months it used to take to find out what offenders live in the neighbourhood,” says Glenn Woods, a retired RCMP officer who helped build the system. 
That’s true. The database has been searched hundreds of times, and although the registry has yet to solve a single crime, the Mounties believe it’s only a matter of time. At the very least, the registry is a starting point for detectives with no other leads.
Of course, a sex offender registry is only as effective as it is accurate—and Canada’s system is certainly not complete. For one thing, it was not designed to be retroactive. Thousands of known molesters and other loathsome criminals were never added to the system in the first place, and even today, barely half of all convicted offenders end up on the registry. Amazingly, inclusion isn’t mandatory. In fact, the RCMP can barely keep track of those offenders who are ordered to comply. According to the latest statistics, 16,295 names appear on the system. Of those, 1,270 (eight per cent) are considered non-compliant in some way. Some haven’t checked in every year, as required. Others have been missing for months. Compliance rates vary from coast to coast. Simply put, some provinces and territories are better than others when it comes to keeping tabs on registered sex offenders. But no jurisdiction is perfect. According to hundreds of pages of internal government documents, obtained by Maclean’s under the Access to Information Act, each region is struggling to make the system work.

Non-compliant offenders: 317 (4%)
Any discussion about the national sex offender registry must begin in Ontario, the home of Canada’s first-ever registry. Launched in 2001, the provincial database is an impressive piece of technology. Every convicted sex offender in Ontario is automatically added to the system, and investigators across the province can log on and see exactly how many people in their region are following the rules. Unlike the national version, which can’t track compliance, if an Ontario offender fails to check in on time, the system will issue an automatic red flag. In Toronto, for example, the city’s sex crimes unit includes a group of officers who do nothing else but monitor the whereabouts of registered sex offenders. “Because I’m obsessed with the number, the first thing I do every day is log onto the system and see where our number is at,” says Det.-Const. Brian James, a member of that unit (James has since transferred to another division).
When the Ontario system was unveiled, Premier Mike Harris was so impressed that he offered the software to the feds, free of charge. Jean Chrétien was prime minister at the time, but his Liberals weren’t interested. First they insisted that Canada doesn’t need a national sex offender registry. Then, under pressure in the House of Commons, they promised to upgrade CPIC, the central police computer that contains everyone’s criminal record. And then—when other provinces stepped in to accept Harris’s offer—Lawrence MacAulay, the federal Solicitor-General at the time, announced a complete reversal in policy. Ottawa, he said, is going to build its own registry. “Ontario pushed them into it,” says Terry Nicholls, a retired OPP staff sergeant who ran the provincial registry. “It was very clearly a knee-jerk reaction. So out of the blue, the feds announced they would build their own. There was no foresight. There was no database on the drawing board. Nothing.”
Instead of borrowing Ontario’s software. Ottawa designed its own distinct database—a trickle-down operation in which the bulk of the costs, and the work, actually falls on the provinces and territories. Each of the 13 regions houses a central registry office run by the RCMP, except in Ontario (the OPP is in charge) and Quebec (Sûreté du Québec). It is up to those offices to ensure the compliance of local sex offenders. In Ontario, however, taxpayers are now on the hook for two separate registries—all because the federal Liberals would not admit that a province, especially one run by a Conservative, had developed a superior system. Three years later, the result has been a long list of technical glitches and bad feelings. In October, when registry officials from every province and territory met for an annual meeting, nobody from Ontario showed up.
Of all the problems with the national registry, nothing bothers Ontario more than the discretionary inclusion rule. Consider this fact: since the day the national system was unveiled, 3,331 people have been automatically added to the Ontario registry (remember, inclusion is mandatory on the provinicial). During that same span, only 1,635—fewer than half—were ordered onto the national registry. The rest fell through the cracks, either because the Crown didn’t ask, or the judge refused. “If those people left Ontario, they wouldn’t have to report to anyone,” says Det.-Sgt. Rick Harrington, an OPP officer who works with both registries. “I’m not against the national registry. It’s just unfortunate that the discrepancy in how we operate leaves some aside.”
BRITISH COLUMBIA
Registered sex offenders: 1,469
Non-compliant offenders: 134 (9%)
The national registry was not designed to be completely retroactive. As of Dec. 15, 2004 (when the system went live) anyone listed on the Ontario version, and anyone else currently serving a sentence for a sex crime, was ordered to comply. The decision meant that thousands of known pedophiles and rapists were not included because they had finished serving their sentences by December 2004. Rational or not, the decision still left police with a monumental task. They had to serve each and every qualified offender—more than 10,500 people—with a written notice to comply (known as a Form 53). In B.C., the Form 53 process proved to a massive undertaking. Many offenders couldn’t be located, and many others couldn’t be bothered to check in. “Letters of Reminder to register were sent to approximately 250 retrospective offenders who were approaching their reporting deadline,” reads one internal report, written in 2006. “Many were returned unopened/non-deliverable.”
That was not the only frustration. In Prince George, local prosecutors refused to charge three retrospective sex offenders with non-compliance because the written notice to comply didn’t specify the exact location of the registry centre. Police were stunned. According to the latest provincial update, written three months ago, the registry centre in B.C. is also still struggling to convince frontline officers to use the database for investigations. The system is off-limits to most police officers, so all queries must be forwarded to the provincial registry centre. However, most detectives feel the same way: If I can’t access the system myself, what good is it? According to that 2006 internal report: “So far this year, 24 requests for NSOR queries have been done. In general, requests for queries are at a minimum as most detachments/agencies are, as yet, unaware of what we can offer.”
ALBERTA
Registered sex offenders: 1,251
Non-compliant offenders: 201 (16%)
Behind closed doors, Alberta has been more than vocal about the many problems plaguing the national sex offender registry. The biggest problem, officials say, is that the database cannot record an offender’s next expected reporting date. That must be done separately—on a Rolodex, for example, or on a wall calendar. In other words, the system cannot tell the RCMP when people are scheduled to register, and when they’ve failed to show up. “No automation leaves a huge margin for error,” says Paige Eisworth, the former acting coordinator of the Alberta registry centre.
Like many jurisdictions, Alberta also has a hard time conducting compliance checks. Not only do frontline officers not have access to the system, police throughout the province don’t always have the time see if sex offenders are living where they say they are. “We have a sex offender population that requires management,” Eisworth says. “And that requires police officers in the communities to go out and investigate and knock on doors. But there has been no allowance or no increase in resources.”
SASKATCHEWAN
Registered sex offenders: 571
Non-compliant offenders: 26 (5%)
Since day one, RCMP officers in Saskatchewan have made it a top priority to monitor compliance—and charge those offenders who aren’t following the rules. Gary McLennan, the Mountie who launched the registry in Saskatchewan, puts it this way: “There are certain provinces that have to do a lot more with regards to it, but that’s up to them to say that.” In 2006, the Saskatchewan registry centre wrote an update to headquarters: “The vast majority of Form 53s are not complying and it is very difficult to give a number of non-compliance investigations conducted in 2006 as we are doing some form of investigation on basically every SO [sex offender]. We have some SOs that have been non-compliant for 3-5 months and we were going to lay a charge and they showed up and registered…Under the present interpretation of compliance we would have to say we are 93% compliant, but that statistic is very skewed and definitely does not speak to the work that is required to get SOs to be compliant.”
The report also expresses “serious concerns” about the fact that many judges aren’t ordering convicted sex offenders onto the registry (Form 52s). “We have had only 90 Form 52s issued thus far in 2006 and our reviews indicate that we should be receiving in excess of 200 Form 52s per year.” At last count, 74 offenders in Saskatchewan have been charged with non-compliance—the highest of any province, by far.
MANITOBA
Registered sex offenders: 696
Non-compliant offenders: 83 (12%)
In Manitoba, the registry is maintained by the province’s Integrated High Risk Sex Offender Unit, a joint task force comprised of RCMP and Winnipeg Police. Although each offender is required to register every year and every time they move, the task force tries to conduct random door knocks at least once a year, ensuring that offenders are actually living where they say they are. “The onus is on the accused to report,” says Dave McInnis, the RCMP sergeant in charge of the unit. “It’s not our job to track these guys down, but we do that in the interest of facilitation. The compliance part of the mandate is extremely important. Without it, there is no sense having a database.”
But resources are stretched thin, and as the list of registered sex offenders continues to grow, it will become increasingly difficult to check on every single person. “Coupled with the demands of the sex offender database, validation and compliance checks, we do find that we likely do not have enough resources to do the job and we are in year two only of the Act with our file numbers increasing,” reads one internal report.
Like all provinces and territories, Manitoba is also handcuffed by the fact that the computer itself cannot track compliance. The legislation that created the registry does not allow the Mounties to record an offender’s next expected registration date, so staff is forced to use a cue card system to keep track of compliance. For the most part, the system is working in Winnipeg, where the task force is able keep tabs on offenders living in the city. But in the rural regions of the province, compliance is much harder to maintain. Because frontline officers are not allowed to access the system, the task force must send out requests to rural detachments, asking local officers to check on certain offenders. “For the most part the detachments have been very good,” reads another internal report, “but some follow up has been needed.”
At last count, there are approximately 20 active arrest warrants for Manitoba residents wanted for breaching the sex offender registry. Some have been missing for months. But the RCMP refuses to release their names to the public—for privacy reasons.
QUEBEC
Registered sex offenders: 2,554
Non-compliant offenders: 480 (19%)
In Quebec, the national sex offender registry is run by the provincial police force, the Sûreté du Québec. The latest statistics reveal that of anywhere in Canada, Quebec has the highest rate of non-compliance. Almost one in five registered sex offenders is non-compliant in some way.
NEW BRUNSWICK
Registered sex offenders: 424
Non-compliant offenders: 5 (1%)
When the registry launched, officers in New Brunswick filled out 230 Form 53s, ordering retrospective offenders to comply. About a dozen (five per cent) couldn’t be located. “That could mean anything,” says Cpl. Dave Ward, the director of the provincial centre. “They could have been in another province. They could have died. I know there was one instance where the fellow was in his 90s and permanently in a seniors’ home, so the decision was made not to proceed with him.”
Overall, compliance rates in New Brunswick are relatively high. Last year, Ward and his staff implemented a system of random checks that will ensure each offender is visited by police six months after he registers. Every month, Ward contacts local police jurisdictions and forwards a list of offenders whose addresses need to be verified. Unfortunately, not every police force can spare the officers. Between May and September 2007, Ward sent 156 compliance check requests to various detachments across the province. Only 59 (38 per cent) were actually completed.
In a recent update to headquarters, Ward summed up the problem this way: “The District Commander of the district with the greatest percentage of clients living in their area does not support them being done at this time, due to lack of resources (personnel).” District commanders, he continued, “will have to receive the message from Ottawa on the importance of conducting [compliance checks and address verifications] if we expect to receive support.”
PRINCE EDWARD ISLAND
Registered sex offenders: 53
Non-compliant offenders: 0 (0%)
PEI is the only province to boast a perfect compliance rate. A single RCMP officer, Cpl. June Ramsay, is in charge of keeping an eye on the province’s registered sex offenders. “To date all subjects are in compliance and no problems have surfaced in this area,” she wrote in a recent update. The only problem, she said, relates to Form 52s. When a judge orders an offender to comply, the Crown attorney doesn’t always forward the approved Form 52 to the registry centre. “There have been times when the documents sit at the court and copies are not forwarded to this office, subsequently I don’t even know they were ordered,” Ramsay wrote.
NOVA SCOTIA
Registered sex offenders: 407
Non-compliant offenders: 4 (1%)
Like many regions, Nova Scotia is just now beginning to conduct random compliance checks. If the early results are any indication, not everyone is living where they say they are. Of the 27 address verifications conducted in Halifax in September, six were incorrect. Two of those offenders are now under criminal investigation for non-compliance. “Through the address verification process, it has been noted that many persons have not fully understood their legal obligations, although it had been previously explained to them upon registration,” according to Nova Scotia’s latest update submitted to headquarters. “Literacy and comprehension levels varied considerably and many registrants appreciated the time spent re-explaining the process.”
NEWFOUNDLAND AND LABRADOR
Registered sex offenders: 299
Non-compliant offenders: 3 (1%)
One of the reasons why the province’s compliance rate is so high is that police in the region conduct random compliance checks “on a very limited basis.” Because the registry is essentially an honour system, dependent on the goodwill of convicted criminals, there is nothing stopping a person from telling police he lives at one address, then living somewhere else until the law comes knocking. As in Halifax, more compliance checks will almost certainly reveal a higher non-compliance rate.
YUKON TERRITORIES
Registered sex offenders: 32
Non-compliant offenders: 7 (22%)
RCMP officers in Yukon are facing the same problem as Mounties across the country: the Correctional Service of Canada (CSC) refuses to tell registry officials when federal inmates are released. That means the registry centres have no idea when hundreds of dangerous criminals are supposed to show up and register. Despite repeated requests, CSC insists it does not have the legal authority to share that information. “Communication with our Territorial Corrections has declined,” reads the latest update from the region. “We are not able to obtain ‘notification of release’ of an offender.”
NORTHWEST TERRITORIES
Registered sex offenders: 89
Non-compliant offenders: 6 (7%)
Tracking compliance in such a remote area is not an easy task. As Cpl. Laurie Smith wrote in her latest update to headquarters: “It is sometimes difficult to do compliance checks in the settlements of the NWT when they are not policed on a regular basis, or the offender lives on the land.” Currently, police are looking for one missing sex offender wanted for non-compliance; three others are under investigation, and charges are pending. Not surprisingly, the Correctional Service of Canada is also hesitant to share information. “The members I have dealt with are really good but sometimes the sharing of information is seen as one-way,” Smith wrote.
NUNAVUT
Registered sex offenders: 221
Non-compliant offenders: 4 (2%)
Nunavut does not conduct regular compliance checks. In fact, officers there prefer to issue reminder notices to overdue offenders rather than charge them with non-compliance. Form 52s are also a problem. Prosecutors either forget to ask for them, or ask for them in cases when a repeat offender is already ordered to comply. “As Nunavut is a limited duration post for most RCMP members and other government officials, we have a high turnover in DOJ [Department of Justice] and RCMP personnel,” reads the latest update, written in November 2007. “This fact, compiled with an extensive case load that our DOJ is facing, leads to missed orders and 2nd orders being issued

Il était impensable, à l'époque, d'imaginer qu'il puisse y avoir pire ! Aujourd'hui, les affaires se multiplient montrant l'existence de ce qu'il serait judicieux d'appeler une Pédophilie d'État, à savoir qu' « un certain nombre de "notables", politiques, magistrats et hauts fonctionnaires, disposant de pouvoirs institutionnels conséquents, sont "tenus" par des systèmes mafieux aux travers de "loges sataniques" criminelles qui utilisent le sexe et ses dérives les plus perverses, la torture et les meurtres collectifs, tout scandale étant écarté par un système judiciaire aux ordres où les accointances "maçonniques" jouent un rôle majeur. » (Voir Les dessous de l'affaire Allègre)

Ainsi, et pour prendre quelques exemples, Le Canard Enchaîné du 23 juillet 1997 avait dénoncé : « Lors de l'opération lancée par la gendarmerie contre les acheteurs de cassettes pédophiles, on avait aussi remarqué l'absence de certaines catégories professionnelles, dont celle des magistrats. Soixante et onze d'entre eux figurent pourtant sur la liste de ces clients ! » Il a donc suffit d'une seule opération de gendarmerie dans les milieux pédophiles pour y trouver impliqués pas moins de 71 magistrats français (soit 1 % de notre magistrature) ! Dans ces conditions, comment s'étonner que tant d'affaires de pédophilies soient étouffées...

On se rappelle tous de « la petite » affaire Dutroux, pédophile notoire et criminel. Mais où est passé « la grande » affaire Dutroux ? Cette intrigue apportait les preuves que Dutroux était membre d'un important réseau impliquant de nombreux notables belges jusqu'aux plus hautes sphères de l'État. Les témoignages de Mademoiselle Régina Louf sont, sur ce sujet, plus qu'accablants !

Monsieur Stan Maillaud, après avoir diffusé le témoignage d'un enfant victime (voir sur internet « l'affaire Vincent ») se voit menacé de mort et obligé de fuir les instances politico-judiciaires de notre pays. Son site internet lepeededamocles.info et les informations qu'il contenait ont été purement et simplement supprimés.

Monsieur Marcel Vervloesem a frolé plusieur fois la mort en prison et a été détenu dans des condition abject. Son crime ? Avoir donné à la justice un CD Rom regroupant 8500 documents de 472 enfants violés. Les autorités belges pourraient ainsi détruire les pièces à conviction concernant les auteurs de crimes sur 90.081 enfants victimes (en vertu de la loi limitant la conservation des données à caractères personnels à la durée d'une enquête).

Il est évident, au vu des nombreux témoignages, que ces groupes rassemblent ce que le domaine psychiatrique nomme des pervers narcissiques. À savoir : « Des individus présentant une personnalité marquée à la fois par un narcissisme exacerbé et des traits de perversion morale. Ils ont un total mépris pour toutes lois ou contraintes. Leur éthique est, le plus souvent, celle de la loi du plus fort et/ou du plus rusé. “The Troll Patrol:” Protecting yourself against vigilantism

Vigilantism is one of the most prevalent concerns among sex offenders, as stories abound regarding the harassment, vigilantism, and
even murders of Registered Citizens or those merely accused of sex crimes. Registered Citizens are so reviled in the community,
even the accusation that a person is a pedophile, untrue it may be, has led to “vigilantism” or “organized stalking” against the
accused. “Vicious lies are circulated throughout the community, and these lies don’t stop. Such lies as the target is a prostitute, a
drug user, a drug dealer, has a long criminal record, or the highly destructive favourite (applied to men and women,) the target is a
pedophile… ‘vigilante stalking’ is sometimes used because of the false allegations that targets are active criminals.” (Eleanor White,
Organized Stalking- A Taboo Subject.” www.opednews.com, July 4, 2007). Vigilantism is a real threat; however, there are things
you can do to protect yourself from being targeted by vigilantes.

Vigilantism at its worst: Murders and Assaults

The most extreme form of vigilante violence is murder. A number of stories have appeared over the years, which solidifies the fear
many registrants have about becoming a target by random vigilante thugs:
1.       SC- July 2013: A husband and wife duo and members of a Skinhead gang, Jeremy and Christine Moody, killed a registrant
and his wife after looking them up on the public registry
2.       WA- June 2012: Patrick Drum killed two registrants and planned to kill two others in Port Angeles WA, using information
obtained from the sex offender registry.
3.       CA- February 2009: Ivan Garcia Oliver murders a neighbor after finding him on the Megan's Law website.
4.       ME- April 2006: Stephen Marshall drove from Canada to Maine to murder two registrants after selecting them from the state's
Megan's Law website.

As of 2012, eAdvocate has documented 432 known murders of registrants or people accused of committing sex crimes.
Furthermore, a study by Jill Levenson and Richard Tewksbury entitled "Collateral Damage: Family Members of Sex Offenders"
found that 44% of family members experience threats and harassment, 27% experienced property damage, and 7% were physically
assaulted.

My intent here is not to scare you into paranoia, and I hope you never have to use these tips. However, in the event you are harassed
or you feel your life is threatened, there are a number of things you can do to minimize your risk of becoming a target; nothing is
100% effective, but following some common sense rules. Home surveillance systems and owning dogs are well known and relatively
easy to find options, and can alert you to intruders. Large dogs with a reputation for being guard dogs become visual deterrents to
would-be intruders.

In addition, get into the habit of documenting everything. If you have a telephone harasser, it is imperative you discuss your options
with your phone company. Unfortunately, most cell phone providers don't provide services like call blocks, but even if a person calls
from an unlisted number, that call can be traced (though it may take a court order to retrieve the information). If your harasser is
driving by and shouting obscenities, film him in the act. Most people own cell phones, and virtually all cell phones have some form of
recording capabilities.

Online Vigilantes and Trolls

The Internet has become a necessity in today's culture, but it has also given people the ability to harass and annoy people with a large
degree of anonymity. This emboldens people to say and do things they don't have the guts to do in person. It is easy to get caught in
"flame wars" or feel the need to defend yourself from attacks on online message boards. It is a feeling of helpless to see someone
insult your personhood, your family, or make up lies about you. Even I get sucked into the occasional flame war.

But should you really be worried that someone going by the screen name "roar4truth" is pestering you online? It depends. Many
malevolent online entities are merely "trolls," people who are online just to pick an online fight for fun (or to use Internet slang, "for
the lulz"). It is important to separate annoying but relatively harmless trolls from actual cyber-stalkers.

Cyber-trolls

Trolls are named for a fishing technique, not a mythical creature.  “The troll posts a message, often in response to an honest
question, that is intended to upset, disrupt or simply insult the group” [Andrew Heenan (2013), “Internet Trolls,“ www.flayme.
com/troll/
] The Flayme site finds the following to be characteristics of the cyber-trolls;  I adapted the definition specifically for
registrants:
  • Lack of Imagination: Posts comments just to inflame
  • “Pedantic to the extreme:” Rather thorough posts that, while appearing as ludicrous, elicit sympathy and leads to division. A
    typical tactic is posting threads that simultaneously attack sex offenders as “pedophiles” and paint themselves as a victim of
    your post.
  • False Identity: Will never reveal real names due to cowardice, though these days, security reasons have led many to use
    pseudonyms. Many cyber-vigilante “non-profit organizations” do not have physical addresses, and they tend to have multiple
    screen names as well. It begs the question, “If what they do is right in the name of justice and the law, why hide your
    identity?”
  • Cross-posting: Trolls tend to post the exact same post everywhere they go, and tend to post it whether it is relevant or not.
  • Off-Topic Posting: Can be genuine errors; “a BRIEF opposite response is simply "netiquette;" if it’s a troll post, you have
    denied it its reward.” In other words, don’t get goaded into arguing
  • Repetition: Trolls tend to repeat the same rhetoric everywhere they go. Trust me, I’ve heard the same sex offender myths
    repeated by the same few people in every post in the last two months
  • Missing The Point: “Trolls rarely answer a direct question- they cannot, if asked to justify their twaddle…” My experience has
    been either they do not have a source to quote or the post a link to their gossip sites as “evidence”
  • Thick or sad: They “rarely make what most people would consider intelligent conversation,” but brag of having a high IQ.

The general consensus is the number one rule to dealing with trolls is simply IGNORE THEM! It is better to not engage them at all,
and if you do, keep it brief and to the point. If you counter an “F*** You” with your own “F*** you,” you are merely goading them.
If you ignore them, most will give up. Many are merely attention seekers, seeking others who will give them sympathy, justify their
actions, and make them feel important. Thus, ignoring them hurts them.

Cyber-stalkers/ Online Vigilantes

The more active you are in sex offender activism, the more likely you will become a target for the myriad of cyber-vigilante
organizations online. While this form of cyber-vigilantism is less prevalent, it is more dangerous because it is more intrusive,
menacing, and persistent. You become the object of the cyber-stalker's obsession. Many online vigilantes are members of groups of
like-minded individuals or at least share information with one another. The Flayme.com definition is:
  • “At its mildest, a stalker is simply a troll that has attached itself to an individual. At worst, boring, at best, flattering. But a
    stalker can be a serious predator, using the Internet to pursue a real or imagined vendetta, or other perverted agenda. Risk
    assessment is an essential first step.” (Andrew Heenan, “Internet Stalkers.”
    www.flayme.com/stalker/, 2007).

According to www.wiredsafety.org/cyberstalking_harassment/definition.html, the traits of a cyberstalker:
  • Malice: The desire to hurt you
  • Premeditation: The presence of planning or organization
  • Repetition: The activity is not a one-time incident
  • Distress: The activity causes you fear or distress
  • Obsession: Harassment won’t stop, despite repeated warnings
  • Vendetta: Wants “revenge” on you
  • No Legitimate Purpose: No valid purpose aside from causing you harm
  • Personally directed at you
  • Disregarding warnings to stop
  • Harassment: As defined by state statute
  • Threats (www.wiredsafety.org, “Cyber 911 Emergency: Definition," 2008)

If you have joined with groups like RSOL, SOSEN, USA FAIR, or other support or legal reformist website, you may become a target
of online vigilantes at some point. In 2008, when I first wrote this article, most online vigilantes were affiliated with Perverted-Justice
(Wikisposure)  and Absolute Zero United. As I revise this article in 2013, those sites are defunct but replaced with sites like Evil-
Unveiled, No Peace For Predators, and individuals like Valerie "Valigator" Parkhurst of Davie, FL. Below are the tactics of a cyber-
stalker:
  • Publishing your personal info online at their website: This is done primarily to incite members or supporters to harass
    targets by mail or phone (Julia Scheeres, “
    They Wanted To Teach Him a Lesson.” www.wired.com, March 19, 2004)
  • Hacking into computers, websites, or servers: Done for a variety of reasons, such as to obtain your personal information or
    to disrupt your activities. Of deeper concern is the possibility of “browser hijacking,” as a few cases have surfaced where
    computers were allegedly embedded with porn without their knowledge (John Leyden, “Child porn case highlights browser
    hijack risks.” The Register, UK, May 13, 2004, http://

  • Impersonation: The creation of identities, screen names, or websites with your name and likeness. For example, a troll
    targeting me put up an attack blog, posting up personal information obtained from the Ohio Registry, doctoring up the picture
    from my SO flyer, and using my real  name as a screen name.
  • Harassment: can be though any media- phone, mail, or e-mails sent either to you directly OR to people you know, I.e.,
    friends, family, co-workers, etc. (Marcell v. Perverted Justice.com, CV-06-0693 [US Dist Ct New Mex., Aug 3, 2006)
  • Mobbing/ ganging up: A favorite tactic of members of stalking groups, members of that group (or perhaps even multiple
    screen names of one individual) will flood chatrooms, forums, or other places you post your opinions, either in an attempt to
    drown you out, or to attack you en masse.
  • Virtual Stalking: It should come as no surprise, but online stalkers tend to follow you around the Internet. As an example, I
    used the screen name "fallenone" for many years; in doing so, I made it easy for a cyber-stalker to find me by Googling my
    screen name, and he would follow behind me and post attack info behind all my posts.

So you may have a cyber stalker, so the question is how do you handle it? The hard part is the nature of the Internet itself, along
with a lack of consensus on the seriousness of cyber-terrorism, as evidenced by the recent high profile case of the 13-year-old who
committed suicide after she was targeted by a cyber bully. See also the 1999 Report on Cyber Stalking (www.usdoj.
gov/criminal/cyber crime/cyber stalking.htm). In short, local law enforcement may lack the capacity (or the desire) to handle
Internet-related cases.

Below are a few methods of dealing with cyber-stalkers I have adapted from various sources. It is up to you to decide which method
you prefer:
1.       Ignore them as you would a troll: Most cyber-stalkers are annoying you get a rise out of your reactions, and if you ignore
them or at least not directly address them, most will get aggravated and give up.  Noted as the best of the approaches by most
people, as many cyber-stalkers are motivated similarly to trolls.
2.       Take a stand: Bring to light their actions. For example, if they post derisive remarks online and they attack you in a later
forum, provide a link to the original post and remind them you’re onto them. Use restraint however, as many play the “blame
game,” making YOU out to be the aggressor. If you do choose this approach, just be careful with your words. Minimize your
personal attacks and communications while maximizing your public response; make interactions impersonal.
3.       The “Tit for tat” approach: The organized stalkers tend to troll your every post and use everything you say against you, so
you should use their techniques. Keep a log of their posts, and if you wish, open up a webpage to showcase their foolishness.
Many of them use Google’s free “Blogspot” page, so feel free to do the same. Dig up information on them like they have you.

Below are a few tips you can use when dealing with a cyber-stalker:
  • Remove personal info from all public profiles such as Facebook. It amazes me how easy I've been able to out many online
    vigilantes because one day the stalker connected their online vigilante profile to some real life interest. It only takes one
    mistake for me to make a connection between a fake profile and a real profile. If I can do this rather easily, you can be
    assured so can the vigilantes (besides, I've learned a few techniques from them).
  • Maintain a separate activist account: If you are an activist, then create an activist profile separate from your personal or
    business accounts. You may also want to consider using an anonymous web browser like Tor, which masks your IP address.
    Some sophisticated individuals can trace you by IP addresses.
  • Watch Your Mouth: Be sure not to give out too much info. Be mindful that people can "out" you by such relatively mundane
    things as a general interest (If you like Skyline Chili than you probably live in or close to Cincinnati, for example). Giving out
    TMI like specific birthdays, pictures of yourself or family on Facebook, or specifics when telling your story can reveal your
    identity. Instead of saying "On January 4th I was arrested in Dayton, Ohio," you can say, "Last winter I was arrested in
    Ohio." Watch out for catchphrases as well. If you say "that's so radical" a lot, for example (a rarely used term these days
    unless you still watch TMNT), then a cyber-stalker may be able to figure out who you are by your speech.
  • Save all online activities, including chatlogs. There are many ways to save information. These days, most web browsers
    offer some sort of "screenshot" technology; for Firefox I used "Fireshot" and for Google Chrome I use "Webpage
    Screenshot." You can also cut-and-paste info to a Word Document or even save the entire webpage to your computer.  
  • DO NOT believe anyone in these groups are trying to help you. In fact, they are trying to obtain as much information as
    possible to use against you later or con you out of money. So if a group offers you the opportunity to remove the info from
    their websites for a price or offers you the chance to plead your case to them, do not accept it.
  • If this leads to phone harassment, trace every threatening call, even if you have to pay for it. You could block calls from
    unlisted numbers, and pressing *59 will keep a log in the phone company computers in case you  need to call the police later.
    Also, in most cases you can record phone conversations; recording laws require only the consent of one party to record a
    conversation. Thus, you are one of the two parties in a phone conversation. I actually used my camcorder to tape a
    conversation in a civil case, which helped me win.
  • You can also take legal action- civil or criminal. Civil litigation can be expensive but in many cases, civil litigation may be
    the only deterrent if the person has any assets.

Scams and Extortion

When you consider the level of desperation the average registrant experiences under persecution, it should be no surprise that a
number of websites and email scams targeting Registered Citizens are out there. This is a bit different than online trolls or stalkers,
because the intent is simply to scam you out of some money or assets, but it is no less aggravating.

Below are some typical scams that are out there on the Internet specifically targeting Registered Citizens. This is by no means
comprehensive, but these examples will give you an idea of what to look for:
  • Offendex/ SORArchives (Mugshot Websites Scam): Offendex/ SORArchives is a scam that steals public registry information
    and, for as much as $699, offers registrants the opportunity to pay to remove the information from their websites. Of course,
    they simply create new websites and the scam continues some more. Offendex is currently in litigation over this extortion
    practice. For more info on this company visit

  • FBI Alert Virus: The way this scam works is a notice pops up claiming you are locked out of your computer by the "FBI"
    and accuses you of engaging in some form of online activity. It prompts you to pay to unlock your computer. This, of
    course, is a scam. The FBI didn't lock your computer; instead your computer has received a new type of virus called
    "ransomware." As the name suggests, the scheme involves locking you out of certain computer functions (holding it as a
    virtual hostage) until you pay a fee. There are a few incarnations of this virus, and there are a number of sites offering tips on
    repairing computers infected with this virus online.
  • The Classic Scams: These scams are more personal, but your typical scams used on everyone else. A number of individuals
    are offering services like books claiming to teach registrants to avoid detection legally, how to get off the registry, or claiming
    to offer information for a price. Granted, there are a number of legitimate services like this website that collects donations for
    services, so not every website requesting money is a scam. Checking out the website and its owners are key.

Legal issues with cyber stalking

Like most issues concerning the Internet, cyber stalking laws are difficult to enforce, given the anonymity of the Internet and the
lack of general knowledge of the very nature of the Internet itself. For example, though many networks and service providers have
“Acceptable Use” policies against harassment and stalking, in most instances, it is difficult to get certain activities such as bogus web
pages of you removed. For example, consider the following disclaimer from Google’s “Blogspot” service, in which they effectively
claim no responsibility :

We do not remove allegedly defamatory content from www.google.com or any other U.S. dot com domains. US domain sites such as
Google.com, Blogger, Page Creator, etc. are sites regulated only by U.S. law. Given this fact, and pursuant to Section 230(c) of the
Communications Decency Act, we do not remove allegedly defamatory material from U.S. domains. The only exception to this rule is
if the material has been found to be defamatory by a court, as evidenced by a court order.  The language of Section 230(c) of the
Communications Decency Act fundamentally states that Internet services like Google.com, Blogger and many of Google’s other
services are re-publishers and not the publisher of that content. Therefore, these sites are not held liable for any allegedly
defamatory, offensive or harassing content published on the site.” (“Defamation Definition.” www.blogger.com)

If you truly feel threatened by an online stalker, the best course of action (according to both eadvocate and wiredsafety.org) is file a
report with local law enforcement. The police may not have the tools to fight the stalker. They don’t have to- The main goal is to
subpoena the ISP to provide the information necessary to uncover the identity of the cyber stalker. You might want to contact
cyberstalking@wiredsafety.org for assistance, though I’m unsure how willing they would assist a sex offender. Eadvocate suggests
you DON’T use the “Cyber Tip Line,” because they affiliated with the NCMEC and controversial founder John Walsh. It may be
possible to file a complain though the FBI’s Internet Crime Complain Center (IC3) at, http://www.ic3.gov/, though the site seems
made for Internet fraud. (eadvocate, “Laws and Contacts to Assist Registrants (former sex offenders) in Filing Complaints of
Harassment, Stalking, Cyber-Stalking or Property Damages
.” www.sexoffenderresearch.blogspot.com/ Sept. 4, 2007)

Each state has their own laws regarding stalking or harassing communications. Again, www.wiredsafety.org has a list of links to
individual laws regarding stalking laws. It is important to check the applicable laws in your state.  In Ohio, for example, the
requirement is three occurrences are necessary to file a harassing communications complaint. A state-by-state guide to cyber-stalking

Police have an obligation to investigate cases of cyber stalking. “It is the policy of the US to ensure vigorous enforcement of federal
criminal laws to deter and punish trafficking in obscenity, stalking, and harassment by means of a computer” (47 US Code Ann.
Section 230-b-5)

You may also wish to consider suing in civil court for damages. Civil court has a lower burden of proof, plus monetary
repercussions tend to make most people reconsider their position. Consider the recent case Marcell v. Perverted Justice.com, CV-06-
0693 [US Dist Ct New Mex., Aug 3, 2006] (http://www.corrupted-justice.com/article23.html). While even hate organizations like the
KKK have constitutional rights of their own, they have limits on their actions.  Essentially you are free to hate all you want but you
cannot put your hate into action. Typical civil charges may include charges of slander, defamation of character, harassment,
impersonation, libel, and dissemination of personal information. Considering Pee-J’s recent 501[c] 3 status, now there is at least a
physical address should your harasser be one of them.

Keep in mind, however, the likelihood of winning a defamation suit is slim. The schema for defamation is:
1.       False and defamatory statement regarding another
2.       Unprivileged publication of the claim to a third party
3.       Rising, in the case of matters of public concern, to at least negligence by the publisher, or worse,
4.       Damages to the subject (Kelly O' Connell. "Internet Law- Understanding Internet Defamation." IBLS Internet Law, www.ibls.
com, Oct. 10, 2007)

There have been only a handful of victories regarding Internet defamation:
  • Scheff v. Bock, CACE03022837, 17th Judicial (Broward Co. FL 2007): Woman was awarded $11.3 Million in damages, but
    the case was won by default as defendant failed to appear in court to challenge it
  • Marcell v. Perverted Justice.com, CV-06-0693 [US Dist Ct New Mex., Aug 3, 2006]: Again, won by default


Law Enforcement and the “Public Duty Doctrine”

Of particular concern with Law Enforcement is a general reluctance to assist with your case based on a sex offender label. Police
officers are usually covered by the “public duty doctrine,” which basically states the police have an obligation to protect the public
rather than any individual. In other words, police have a rather large amount of discretion in deciding to investigate a complaint.
However, there are exceptions to this doctrine which can make police officers civilly responsible for failing to protect you as a citizen
(Karen J. Kruger, “Duty To All- Duty To No One: Examining the Public Duty Doctrine and Its Exceptions.” The Police Chief, IACP,
May 2007, www.policechiefmagazine.org).

1.       “Danger creation exception: a complainant must show that the government’s action or inaction “affirmatively placed the
plaintiff in a position of danger, that is, where state action creates or exposes an individual to a danger which he or she would
not have otherwise faced.” Gross negligence does fall under this category.
2.       “Special-Relationship Exception:” a principle of law that allows for suits based on negligent police protection where the
plaintiff can demonstrate that there existed a special relationship between the injured person and the police. Generally, such a
relationship will be found “where the government singles out a particular party from the general public and affords that person
special treatment.” I’m not fond of calling the relationship between RFSOs and LE “special,” but it may be worth it in cases
of gross negligence by the police.

Conclusion
1.       In most cases, it is best to ignore most Internet trolls and stalkers.
2.       If you cannot resist the urge to converse with them, be very VERY V-E-R-Y!!!!! careful with your words, since twisting
your words is a typical tactic of such individuals.
3.       Log all instances of harassment of any form for future reference. Use anything-- cameras, cell phones, camcorders, whatever
you  have handy
4.       DO NOT cooperate or send money to individuals in exchange for getting off a private registry or in exchange for information
making outlandish claims or services. Remember the old adage, "If it sounds too good to be true, it probably is."
5.       Local law enforcement agencies are usually the agency you will have to file a charge with, rather than the FBI. HOWEVER,
you should also file a complaint with the FBI Cyber-crimes unit at www.ic3.gov.
6.       Also, a civil case against the harasser may be of help as well.
7.       Whatever you do, NEVER confront a harasser on  the street, and get away from that person should (s)he approach you on
the street.

I have been an activist since 2004, fighting for the rights of registered citizens ("sex offenders"). I am also on the registry. In 1999, I made
a mistake-- I kissed an underage girl. She was somebody I knew, and I knew better. I am what you call a "situational offender." I was
arrested in 2000 and convicted in 2001 (I sat in jail a full year before my conviction.) I served 37 months of a six year sentence in an
Alabama State Prison, and was released in April 2003. I never chose to become an activist, but after I spent years in vain laying low,
working and paying bills, and bothering no one, I was targeted by local politicians determined to use registrants like me to further their
careers. I was forced out of one residence formerly pre-approved by the authorities, and had to fight to keep my second residence. My
activism was inspired by my struggle to survive.

I am not against punishment for people who commit sex crimes. However, I believe punishment should be coupled with prevention and
rehabilitation programs. I have lived under these laws for over a decade, and I have experienced the social ostracism, the denial of
housing and employment services, and harassment that is common to those on the registry. My first taste of online activism came in 2004
through a defunct website called "sexcriminals.com." My fellow activists have helped me through some tough times over the years. Today,
I fight to bring wholesale reforms of America's sex offender laws, including abolishing residency restrictions, the public registry, and
community notification, as well as promote programs that emphasize education and prevention of sexual abuse programs. Healing for
both victims and offenders should be emphasized.

I created this site to help educate the public as well as assist my fellow activists. In 1999, before my arrest, I earned a Bachelor's in
Justice Studies from Athens State University (in Athens, AL). I bring a decade of practical and research experience on the subject of sex
offender laws. Over the years, Once Fallen has become recognized as a leading source of factual information on sex offender laws.
Registrants, counselors, lawyers, and even law enforcement officials have utilized the information here. I have made many media
appearances to help further the cause.
